MEDIATION & ARBITRATION EXPERIENCE:

     Mediation experience ranges from two party disputes to sixteen parties, settlements which required no to substantial financial payment, and mediations which settle in less than two hours to those that required three days. Arbitration experience includes panel participation. The spectrum of

legal issues has included: business disputes, homeowner association disputes, probate, bankruptcy preferences, employment claims, consumer complaints and warranties, construction, real estate, landlord tenant, and general contractual disputes.

 

 

PERSONAL MEDIATION STYLE:

     Tenacity, reason, knowledge and experience in finding solutions are essential aspects of Pamela’s ability to successfully mediate disputes.  Pamela’s mediation styles range from a legally grounded assessment and evaluative style to an explorative and facilitative style, depending on the needs and preferences of the parties and the facts of a matter. In all mediations, confidentiality and respect are of utmost importance.

     Ms. Ferry believes the newly enacted California ethical standards for private contractual and consumer arbitrations (see article on this topic under “Articles” tab of this website) is a giant step toward insuring fairness to arbitration participants and an

     Firm specializes in providing experienced in-house attorneys and legal specialists to businesses. Legal services have included business transactions and contracts, formation and representation of corporations, partnership, and limited liability companies, directors and officers liability issues, employment law matters, all types of real estate matters (commercial and residential leases, commercial and residential association documentation and governance, purchase contracts, construction matters, easements, title claims, zoning and development issues), tax issues, mediation and arbitration representation and preventative law services. Sample of clients include: Federal Deposit Insurance Corporation; San Diego Unified Port District; Callaway Golf Company; Professional Recruiting,

Inc., and Evergreen Organics, Inc.  Representation of FDIC included: successful return of $3.5 million security deposit on land lease in Federal Court, case won on motion for summary judgment and upheld on appeal.

 

Legal Counsel - HomeFed Bank, FSB and FA     (August 1991 to October 1994)

     Responsible for providing advice to the Bank’s Business Departments, Board of Directors and subsequently the Resolution Trust Corporation. Principle responsibilities included: lease and sale of $1 billion commercial REO portfolio and employment matters.

 

Attorney - Saxon, Dean, Mason, Brewer & Kincannon (March 1989 to April 1991)

     Real Estate Litigation and Transaction attorney representing a wide variety of financial institutions throughout Southern California. Transactional experience included loan documentation, workouts, leasing, construction funding issues and real estate transactions. Litigation experience included representation of clients in major Federal Court cases

involving complex real estate financing matters.

 

Attorney - Jenkins and Perry now Musick, Peeler & Garrett    (May 1987 to March 1989)

     Real Estate litigation and transactional attorney. Litigation responsibilities included: representation of U.S. Brass in numerous construction defect defense cases. Real Estate transactional responsibilities included: preparation of real estate, documentation, formation of

covenants, conditions and restrictions, representation of homeowner associations in homeowner meetings and litigation, and advising clients on real estate, land use and environmental issues.

 

Judicial Extern - California Fourth District Court of Appeal    (Fall 1986)

     Research and preparation of legal memoranda and draft opinions for Justice Gerald J. Lewis.
